1. Introduction and Acceptance

Welcome to Zumia, an AI-powered CV optimisation service. By accessing or using Zumia, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

You must be at least 16 years of age to use Zumia. By using the service, you confirm that you meet this age requirement.

2. Service Description

Zumia is an AI-powered CV optimisation service. You provide your CV and job specifications, and our service uses artificial intelligence to generate tailored suggestions for improving your CV for specific job applications.

The AI assists you in the optimisation process, but you make all final decisions about your CV content. Zumia is a tool to support your job application process - it does not make decisions on your behalf.

3. Account Registration

To use Zumia, you must create an account with a valid email address. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us promptly of any unauthorised access to your account.

Each person may hold only one account. You may not create multiple accounts to circumvent limits or restrictions.

4. AI-Powered Features

Zumia uses OpenAI to provide AI-powered CV optimisation. Please be aware of the following:

  • AI-generated content is provided as suggestions only and does not constitute a guarantee of quality, accuracy, or completeness.
  • AI may produce inaccurate, incomplete, or inappropriate suggestions. You are solely responsible for reviewing, verifying, and approving all AI-generated output before using it.
  • The AI does not make decisions on your behalf. All final decisions about your CV content remain yours.
  • You should not rely solely on AI-generated output for important career decisions. Consider seeking professional advice where appropriate.
  • Zumia does not guarantee that using the service will result in successful job applications or employment outcomes.

5. Content Ownership and Licensing

Your content: You retain full ownership of all content you provide to Zumia, including your CVs, job specifications, and knowledge library items. Zumia does not claim any ownership rights over your content.

AI-generated output: You receive full usage rights to all AI-generated output (such as optimised CVs and suggestions) without restriction. Zumia does not claim ownership of AI-generated output created for you.

Limited licence: By using Zumia, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the service to you. This licence ends when you delete your content or your account.

6. Credits and Billing

Zumia operates on a credit-based system. Each credit enables one job application optimisation workflow. Free credits may be provided when you sign up.

Additional credits can be purchased through Lemon Squeezy, which acts as the merchant of record for all payments. Lemon Squeezy handles payment processing, invoicing, and tax collection on our behalf.

Credits are non-transferable and may not be exchanged for cash. Purchased credits expire 365 days after the date of purchase. Free or promotional credits expire 45 days after they are issued. We will notify you by email when your credits are due to expire - 30 days in advance and again 7 days in advance.

Pricing changes apply only to credits purchased after the new pricing takes effect. Existing credits you have already purchased keep their original value and expiry.

All credit purchases are final and non-refundable, except where required by applicable law, in the event of service discontinuation, or where credits were consumed due to a verified service error.

Usage limits: Each job optimisation workflow includes up to 50 iterative messages. If you reach this limit, you can spend one additional credit to reset the counter and continue. This limit is designed to ensure fair use of the service and is unlikely to be reached in normal use.

Withdrawal right: When you purchase credits and begin using them, you acknowledge that you are requesting immediate performance of a digital service. By using a credit, you agree that the 14-day withdrawal right under the Consumer Rights Directive ceases to apply for that credit, as the digital content has been fully provided.

If we discontinue the service, you may request a refund within 30 days of the discontinuation notice. Any refund will be prorated based on the remaining active purchased credits at the original purchase price. Free or granted credits are not refundable.

7. Acceptable Use

You agree not to:

  • Generate misleading or fraudulent CV content
  • Circumvent or attempt to circumvent usage limits or the credit system
  • Access or attempt to access other users' data or accounts
  • Use automated tools or scripts to interact with the service beyond its intended use
  • Upload content that infringes the intellectual property or other rights of third parties
  • Use the service for any illegal or unlawful purpose

Violation of these rules may result in suspension or termination of your account.

8. Data Handling

Your privacy is important to us. Your data is stored securely with encryption at rest and in transit. AI processing uses zero-retention mode - your data is not used to train AI models. You can export or permanently delete your data at any time. See our Privacy Policy for full details.

9. Service Availability and Disclaimers

Zumia is provided on an 'as is' and 'as available' basis. We strive to maintain a reliable service but do not guarantee uninterrupted or error-free availability. Scheduled maintenance and unexpected outages may occur without prior notice.

The quality of AI-generated suggestions may vary. Zumia is not a substitute for professional CV writing or career advisory services. We do not guarantee any specific employment outcomes from using the service.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Zumia is not liable for the outcomes of any job applications made using content generated or optimised through the service.
  • Zumia is not liable for the accuracy, completeness, or suitability of AI-generated content.
  • Zumia is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • Zumia's total liability to you for any claims arising from or related to the service is limited to the amount you have paid to Zumia in the 12 months preceding the claim.

These limitations apply to the fullest extent permitted by applicable law and do not affect any rights that cannot be excluded or limited under mandatory consumer protection legislation.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

11. Account Suspension and Termination

By Zumia: We may suspend or terminate your account if you violate these terms. Where practicable, we will provide notice before taking action.

By you: You can delete your account at any time through your account settings. Upon deletion, your account and associated data will be permanently removed from our systems in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or through the service. Your continued use of Zumia after changes take effect constitutes your acceptance of the updated terms.

13. Governing Law and Disputes

These terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the competent courts in Switzerland.

If you are a consumer resident in the European Union, nothing in these terms affects any mandatory consumer protection rights you have under the laws of your country of residence.

14. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
